Terms and Conditions

Please read these Terms and Conditions carefully before using the Blue Collar Ops platform. By accessing or using the platform you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using the Blue Collar Ops platform — including the manager dashboard, field app, customer portal, and any related services — you agree to be bound by these Terms and Conditions. If you do not agree to these terms you may not use the platform. These terms apply to all users including company administrators, field workers, and customers interacting with the platform.

2. Description of Service

Blue Collar Ops is a field operations management SaaS platform that provides scheduling, dispatching, GPS tracking, invoicing, payment processing, customer communication, and AI-powered tools for field service businesses. The platform is provided on a subscription basis. Blue Collar Ops reserves the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Account Registration and Security

To use the platform you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify Blue Collar Ops immediately at support@bluecollarops.io if you suspect unauthorized access to your account. Blue Collar Ops is not liable for any loss resulting from unauthorized use of your account.

4. Subscription and Billing

Access to the Blue Collar Ops platform requires a paid subscription. Subscription fees are billed monthly in advance. All fees are non-refundable unless otherwise specified. Blue Collar Ops reserves the right to change subscription pricing with thirty days written notice. Failure to pay subscription fees may result in suspension or termination of your account. All payments are processed securely through Stripe.

5. Free Trial and Demo Accounts

Blue Collar Ops may offer free trial or demo accounts at its discretion. Demo accounts are provided for evaluation purposes only and may contain simulated data. Blue Collar Ops reserves the right to terminate demo accounts at any time. Converting a demo account to a paid subscription is subject to the billing terms above.

6. Acceptable Use

You agree to use the platform only for lawful purposes and in accordance with these terms. You must not use the platform to transmit unlawful, harassing, defamatory, or harmful content. You must not attempt to gain unauthorized access to any part of the platform or its underlying systems. You must not use the platform to send unsolicited communications or spam. Violation of acceptable use policies may result in immediate account termination.

7. SMS Communications

By using the customer communication features of the platform you agree to comply with all applicable SMS regulations including the Telephone Consumer Protection Act. You are responsible for ensuring that your customers have consented to receive SMS communications before sending any messages through the platform. Blue Collar Ops provides the SMS infrastructure but you as the account holder are responsible for obtaining proper customer consent. 8. Data and Privacy

Blue Collar Ops collects and processes data as described in our Privacy Policy at bluecollarops.io/privacy-policy. You retain ownership of your business data including customer records, job history, and worker information. By using the platform you grant Blue Collar Ops a limited license to process your data solely for the purpose of providing the service. Blue Collar Ops will not sell your data to third parties. Blue Collar Ops may use anonymized and aggregated data to improve the platform and AI models.

9. AI Powered Features and Liability

Blue Collar Ops provides several AI powered features including but not limited to the AI Scheduling System, the On-The-Fly Solver, the Passive ML Monitor, and the AI Diagnosis Assistant. By using any AI powered feature you acknowledge and agree to the following:

9.1 Informational Purpose Only

All AI generated content, recommendations, scheduling decisions, diagnostic guidance, and suggestions are provided for informational and operational assistance purposes only. They do not constitute professional advice of any kind including but not limited to medical, legal, engineering, or trade professional advice.

9.2 No Warranty of Accuracy

Blue Collar Ops does not warrant that AI generated outputs will be accurate, complete, current, or suitable for any particular purpose. AI systems may produce incorrect, incomplete, or inappropriate outputs. You are solely responsible for verifying any AI generated information before acting on it.

9.3 Professional Judgment Required

The AI Diagnosis Assistant is designed to assist trained trade professionals — not to replace them. Workers using the diagnosis assistant must apply their own professional training, certifications, experience, and judgment to every situation. The AI cannot see or fully assess on-site conditions, local code requirements, or all relevant factors. Workers must never rely solely on AI guidance when making decisions that affect safety or code compliance.

9.4 Safety Responsibility

In any situation involving potential safety risks — including but not limited to gas leaks, electrical hazards, structural concerns, chemical exposure, pressurized systems, or any other condition that could cause injury or death — workers must stop work immediately and contact their supervisor or emergency services regardless of any AI guidance received. AI guidance does not override professional safety protocols.

9.5 Scheduling and Assignment Decisions

AI scheduling recommendations and solver outputs are provided as operational assistance only. Managers retain full responsibility for all staffing and scheduling decisions. Blue Collar Ops does not warrant that AI scheduling assignments will comply with all applicable licensing, certification, or employment requirements in every jurisdiction. Account holders are responsible for ensuring that workers are properly licensed and certified for all work performed in their jurisdiction.

9.6 Jurisdiction and Code Compliance

While Blue Collar Ops strives to incorporate jurisdiction specific licensing and code awareness into its AI systems, applicable codes and requirements change frequently and vary by location. Blue Collar Ops does not warrant that AI guidance will always reflect the current and accurate requirements for any specific jurisdiction. Workers and account holders are responsible for verifying compliance with all applicable local, state, and federal codes and licensing requirements.

9.7 Limitation of Liability for AI Features

To the maximum extent permitted by law Blue Collar Ops shall not be liable for any injury, damage, loss, fine, penalty, or other consequence arising from reliance on any AI generated output including scheduling recommendations, diagnostic guidance, or solver suggestions. This limitation applies regardless of whether Blue Collar Ops was advised of the possibility of such damages.

10. Payment Processing

Invoice payments processed through the platform are handled by Stripe. Blue Collar Ops is not a payment processor and is not responsible for payment disputes, chargebacks, or failed transactions. Any disputes regarding payments between you and your customers must be resolved directly between the parties. Blue Collar Ops may charge a platform fee on transactions as described in your subscription agreement.

11. GPS and Location Data

The platform uses GPS tracking for worker location services. By enabling GPS features you confirm that your workers have been informed of and consented to location tracking during working hours. You are responsible for complying with all applicable employment and privacy laws regarding employee monitoring in your jurisdiction. Blue Collar Ops is not liable for any claims arising from your use of GPS tracking features.

12. Intellectual Property

The Blue Collar Ops platform — including its software, design, branding, and content — is the intellectual property of Blue Collar Ops and is protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or reverse engineer any part of the platform. Your company name, logo, and data remain your intellectual property. Blue Collar Ops claims no ownership over your business data or branding.

13. Third-Party Integrations

The platform integrates with third-party services including Google Maps, Stripe, Twilio, QuickBooks, Cloudinary, and OpenWeather. Use of these integrations is subject to the terms and conditions of the respective third-party providers. Blue Collar Ops is not responsible for the availability, accuracy, or performance of third-party services.

14. Limitation of Liability

To the maximum extent permitted by law Blue Collar Ops shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Blue Collar Ops's total liability for any claim arising from use of the platform shall not exceed the amount paid by you in subscription fees in the three months preceding the claim. Some jurisdictions do not allow limitation of liability so these limitations may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Blue Collar Ops and its officers, directors, employees, and agents from any claims, damages, losses, or expenses including legal fees arising from your use of the platform, your violation of these terms, or your violation of any third-party rights.

16. Termination

Either party may terminate the subscription at any time. You may cancel your subscription by contacting support@bluecollarops.io. Upon termination your access to the platform will be suspended at the end of the current billing period. Blue Collar Ops may terminate your account immediately for violation of these terms. Upon termination you may request an export of your business data within thirty days. After thirty days Blue Collar Ops may permanently delete your data.

17. Modifications to Terms

Blue Collar Ops reserves the right to modify these terms at any time. We will notify you of significant changes by email or by posting a notice on the platform. Continued use of the platform after changes are posted constitutes acceptance of the updated terms. If you do not agree to the updated terms you must stop using the platform and cancel your subscription.

18. Governing Law

These terms are governed by the laws of the State of Texas without regard to conflict of law principles. Any disputes arising from these terms or your use of the platform shall be resolved in the courts of Travis County, Texas. You consent to the personal jurisdiction of these courts.
